- PRESS RELEASE ON KDSB’S QUESTIONING OF LAND INTEREST SUIT

The allegations by the Deputy Chief Executive Officer of Kuala Dimensi Sdn Bhd (KDSB), En. Faizal Abdullah, that Port Klang Authority (PKA) “tramples and revokes the laws of contract or agreement in Malaysia when necessary” are misleading and inappropriate.

PKA is an aggrieved party in the PKFZ project and has been advised by its lawyers to seek legal remedies in the court of law. The issue of whether PKA is about to breach a contract, as En. Faizal claimed, does not arise. The suit filed last week was part and parcel of the legal actions approved by the Board of PKA to exercise its legal rights arising from wrong imposition and calculation of fees, and fraudulent, wrongful and irregular claims.

On behalf of Port Klang Authority (“PKA”), I announce that PKA today has filed a suit against Kuala Dimensi Sdn Bhd (“KDSB”) at the Shah Alam High Court Registry.

PKA is disputing the imposition of interest in the Port Klang Free Zone (“PKFZ”) land purchase as well as the wrong computation of interest which may have arisen. The total sum in dispute may amount to as high as RM720 million.

1. As instructed by the Port Kelang Authority (“PKA”), I lodged a
report on behalf of PKA with the Malaysian Anti-Corruption Commission
(“MACC”) on Wednesday 26 August 2009 against the following companies
and individuals:

(a) Kuala Dimensi Sdn Bhd (“KDSB”) and its directors, servants
and/or agents being the turnkey contractor for the PKFZ Project;

(b) Datin Paduka O.C.

The Members of PKA deliberated at length the recommendations by the Special Task Force in relation to possible fraud, negligence, wrongdoings and irregularities, as well as the issue of unenforceability of certain agreements.

The board also discussed the issues raised by the Task Force in relation to breaches of fiduciary duty by certain individuals, as well as the conspiracy to defraud Port Klang Authority (PKA) with regards Port Klang Free Zone (PKFZ).

The members of the Task Force also briefed the PKA Members on the rationale of their findings, which include notices of payments which were believed to be false, erroneous or defective.
